Longtime Commissioner of Patents Drew Hirshfeld announced today that he programs to depart the USPTO this summer months.  Until finally that place, he will very likely provide as Performing Deputy Director to help Kathi Vidal strike the floor running as she starts her tenure as USPTO Director.  Hirshfeld writes:

Kathi Vidal … is, without having a question, the ideal person to direct the USPTO. Not only is she very certified, but she has also regularly demonstrated me and so a lot of many others how thoughtful and steadfast she is in her dedication to do the ideal factors for this agency and our nation’s inventors and entrepreneurs. She will be a fantastic leader. . . . I can not feel of a far better way to conclude my time at the agency than by assisting Kathi in any way I can ahead of a long term deputy director comes.

In this framework, Andy Faile will keep on as performing Commissioner for Patents till a new Commissioner is appointed by the Secretary of Commerce. 35 U.S.C. 3 (“The Secretary of Commerce shall appoint a Commissioner for Patents . . . for a time period of 5 several years.”).  Dave Berdan has been serving in the job of deputy director underneath Hirshfeld.  Berdan will most likely return to his position as Typical Counsel — pushing Will Covey back again to his long lasting role of Deputy Common Counsel and Director for the Business office of Enrollment and Self-control (OED).
